Terms and Conditions of Bookings

Cancellation & Amendment Policy

When accommodation is cancelled less than twenty-four (24) hours of the booked arrival date, the Hotel shall be entitled to claim a cancellation fee of 100% of services offered. Changing dates can be done with no penalty (in the sole discretion of the Hotel, and subject to availability), however shortening your stay in less than twenty four (24) hours of the booked arrival date will incur a penalty of 100% of the dates cancelled.

In cases of “No-Shows” the Hotel shall be entitled to claim full compensation for services ordered.

Please Note: For The Capital Pearls and The Capital Zimbali, a cancellation must be received fourteen (14) days prior to booked arrival date.

Terms and Conditions

  • Booking accommodation at the hotel for the purpose of hosting a party is not allowed. Should management receive a complaint from other residents about noise levels, security will facilitate the immediate checkout of the noisy party without a refund, and the Hotel will be entitled to any reasonable damages as may be incurred and/or proved.
  • Deposits will be held as liquidated damages and the guest agrees hereto, the Hotel will further be entitled to reasonable damages in excess of the Deposit, should same be incurred and proved.
  • The guest warrants that he/she is duly authorised to bind his principal as well as each member of his accompanying party to these terms and conditions of residence and failing such authority, he/she agrees to be personally liable for all amounts arising from his residence, including any damages, as well as the residence of any member of this accompanying party.
  • A maximum of 2 visitors per room shall be allowed; should it be discovered that additional guests have made use of the room, the Hotel reserves the right to levy an additional fee and/or penalty.
  • Rates are quoted per apartment/room, per night or per month in South African Rands, inclusive of VAT.
  • The Capital Circle rate is exclusively available on The Capital website.
  • Check in time is 14h00. Early arrivals must be cleared with reservations beforehand.
  • Check out time on day of departure is 10h00. The guest undertakes to deliver the keys to reception. Should the guest depart later than 10h00, and should such late departure not be pre-arranged with the Hotel, or consented to by the Hotel, the Guest will be liable for an additional charge as outlined hereunder, and/or as determined in the sole discretion of the Hotel.
  • The Hotel reserves the right to amend rates at any time without notice.
  • Any extension of stay will be strictly subject to availability at the time of request, and on such conditions as the Hotel may determine in its sole discretion. Guests are advised to notify us as early as possible of any intended extension period.
  • The Capital Apartments and Hotels (Pty) Ltd reserves the right to charge a 5% administration charge on refunds and amendments to bookings.
  • Guests will be responsible for any losses, damage and breakages to the apartment and the inventory or furnishings and the cost thereof will be debited from the guest’s credit card or rental deposit.
  • Smoking is not permitted in the apartments and will be subject to a fine of R1000.00 per occurrence.
  • The rental rates include daily housekeeping, limited personal laundry (applicable in apartments only), electricity, DSTV (satellite television), 24 hour security and parking. The cost of any additional services will be charged against the guests’ credit card or deposit (as applicable) unless alternative settlement arrangements are made prior to departure.
  • No pets are permitted. (Unless otherwise specified)
  • A maximum of 2 people per room are allowed; should it be discovered that additional guests have made use of the room, the hotel reserves the right to levy an additional fee and/or penalty.
  • The owner, its agents and/or employees are not liable for:
    • Any loss or damage to the property or possessions of any guest, resident or visitor, whether such damage was caused by fire, theft or otherwise, or by negligence or the wrongful act, or omission, of the owner, its agents and/or employee;
    • The death of or any personal injuries of whatsoever nature sustained by a guest, resident or visitor, whether such death or injuries were sustained by the negligence or the wrongful act, or omission, of the owner, its agents and/or employee and/or the defective functioning of any apparatus;
    • Any illicit and/or illegal act or conduct by the Guest.
  • All persons entering the premises do so entirely at their own risk.

Guest WiFi Access

The Capital provides complimentary wireless internet access (“the Service”) to guests during their stay. By using the Service, you agree to the following terms, which apply for the duration of your stay:

  1. Provision of the Service
    • The Service is provided on an “as is” basis and use is at your own risk.
    • While reasonable steps are taken to maintain security, we do not warrant that the Service will be uninterrupted, secure, error-free, or compatible with all devices or virtual private networks.
    • Access is available only when your device is within range of our network. We may withdraw, suspend, or change the Service at any time.
  2. Your Use of the Service
    • You may not use the Service to access, upload, or distribute unlawful, defamatory, threatening, obscene, pornographic, offensive, discriminatory, or otherwise inappropriate material; to infringe intellectual property rights; or to disrupt the network or other guests’ use of the Service.
    • Avoid transmitting confidential or sensitive information over the Service, as security cannot be guaranteed.
    • We may terminate or suspend access if we reasonably believe these terms are breached.
  3. Monitoring and Privacy
    • Except for network diagnostics, we do not examine your browsing activity. We may log device IP addresses, access times, and usage activity associated with that IP address.
    • If you opt-in during registration, we may send marketing communications related to The Capital; you can unsubscribe at any time.
    • We comply with the Protection of Personal Information Act (POPIA) and may disclose usage information to law enforcement where legally required.
  4. Liability and Indemnity
    • To the maximum extent permitted by law, we will not be liable for any loss, damage, data loss, business interruption, or other claims arising from your use or inability to use the Service.
    • You agree to indemnify us for any claims made against us arising from your breach of these WiFi terms.
  5. Safe Usage Guidelines
    • Do not open suspicious emails or links.
    • Keep device security settings enabled and software (including antivirus) updated.
    • Do not download copyright material without permission.
    • Use strong passwords and change them regularly.

Late Departures

  • Late departures cannot be guaranteed and are subject to availability.
  • Late Departure Fees:

      • Up to 12:00 : No charge
      • From 12:00 to 14:00 : 45% of daily rate booked
      • From 14:00 onwards : 100% of daily rate booked
    • Loyalty Members
      • Up to 12:00 : No charge
      • From 12:00 to 15:00 : 35% of daily rate booked
      • From 15:00 onwards : 100% of daily rate booked

Payment And Security Thereof

  • Payment Options Accepted
    • Payment may be made via Visa, MasterCard, Diners or American Express credit cards or by bank transfer into the Standard Bank account, the details of which will be provided on request or where relevant.
  • Credit Card Acquiring and Security
    • Credit card transactions will be acquired for The Capital Hotels, Apartments & Resorts via PayU who are the approved payment gateway for Standard Bank of South Africa.
    • PayU uses strong encryption and no credit card details are stored on the website.
    • Users may go to PayU to view their security certificate and security policy.
  • Customer Details separate from Card Details
    • Customer details will be stored by PayU separately from card details which are entered by the client on PayU’s secure site. For more detail on PayU refer to their official site.

Marketing Permissions

By agreeing to our T’s & C’s you will receive communication relevant to your booking with us, and from time to time marketing information. We will not share your information with any 3rd parties. You can easily unsubscribe at any time from our communications by clicking on the link in any of the emails sent to you. Alternatively, contact us and we will action this accordingly.

Payment And Security Thereof

  • Payment Options Accepted
    Payment may be made via Visa, MasterCard, Diners Club, or American Express cards; by bank transfer into our Standard Bank account (details on request); or via our secure payment partners PayUOZOW (instant EFT), and Payflex (BNPL). Bookings via TurnStay are processed through TurnStay’s checkout or its approved payment processors.
  • Card/Data Security & Compliance
    The Capital Hotels, Apartments & Resorts does not collect, store, or have access to your payment card or banking details. All payment data is handled exclusively by our trusted payment partners (PayU, OZOW, Payflex) and/or TurnStay (or their subcontracted processors).
  • These payment providers (or their partners) adhere to industry-standard security frameworks such as the Payment Card Industry Data Security Standard (PCI DSS) and equivalent encryption/standards required by financial regulators.
  • You may refer to each provider’s published security and compliance policies for more information.
  • Future Payment Methods
    We may introduce additional payment options or card formats in the future. All such new methods will be subject to the same security and privacy principles stated here — i.e. that the data is processed by compliant providers (not stored or accessed by The Capital).
  • Customer Details Separate from Card Details
    We store customer contact details securely. These are never stored together with card or banking information.

Marketing Permissions

By agreeing to our T’s & C’s you will receive communication relevant to your booking with us, and from time to time marketing information. We will not share your information with any 3rd parties.
